A lawyer representing a Jewish family trying to retrieve a long-lost Matisse painting looted by the Nazis said Tuesday a deal had been signed with the German government for its restitution.

London-based attorney Christopher Marinello, who works for the Rosenberg family, said that the order inked by German Culture Minister Monika Gruetters had now paved the way for the 1921 masterpiece "Seated Woman" to be handed back.

"I can confirm that an agreement has been signed for restitution of the Rosenberg Matisse," he told AFP in an email, following a report in German daily Frankfurter Allgemeine Zeitung to be published Wednesday.

Heiress Might Sell Looted Klimt Painting

A portrait by Gustav Klimt could be put up for sale, potentially fetching over $30 million, to resolve a dispute between a Viennese art foundation and the granddaughter of the woman in the painting, a lawyer for the granddaughter said on Thursday.

Klimt, an Austrian symbolist, painted the portrait of Gertrud Loew in 1902 and it belonged to her at least until 1938, a year before she fled Austria to escape the Nazis.

Her U.S.-based granddaughter, Andrea Felsovanyi, has been contesting ownership with the private Klimt Foundation, which currently holds the work.

The Henie Onstad Art Center in Norway has agreed to return a portrait by Henri Matisse to the family of Paul Rosenberg, a Jewish art dealer who had his collection confiscated by Nazis during World War II. The museum was founded in 1968 by the Olympic figure skating champion, Sonja Henie, and her husband, Niels Onstad, a shipping magnate and art collector.

The Matisse painting was among the 162 works seized from Rosenberg by Nazis in 1941. The canvas was briefly in the possession of Hermann Goering, a leading member of the Nazi party. Onstad acquired the Matisse painting, “Woman in Blue in Front of a Fireplace,” in 1950, unaware of its troubled provenance. In 2012, the Rosenberg family’s lawyer contacted the Henie Onstad Art Center and demanded the restitution of the painting. After an extensive investigation, the museum decided to return the work to Rosenberg’s heirs. The painting, which had been one of the museum’s most popular works, is estimated to be worth around $20 million.

Norway is a signatory of the 1998 Washington Conference Principles on Nazi-Confiscated Art, which requires museums to examine their collections for potentially looted works. If stolen works are found, the museums are required to try to locate the rightful owners. The Henie Onstad Art Center investigated the Matisse painting’s past only after being contacted by the Rosenbergs’ lawyer.

A federal judge has dismissed a lawsuit brought against The New Yorker and one of its writers by Peter Paul Biro, a forensic art expert. Biro was the subject of a 16,000-word article about art authentication and the process of matching fingerprints on paintings to the artists who created them. Biro claimed that the article, which was published in The New Yorker in July 2010, left readers with a negative impression of him and his work.

Judge J. Paul Oetken dismissed the case saying that the writer, David Grann, did not act “recklessly” or vilify Biro. The ruling, which was released on Thursday, August 1, 2013, applied to Gawker Media, Business Insider, two additional websites and a biography of Jackson Pollock published by Yale University that mentioned Grann’s New Yorker article.

Biro’s lawyer, Richard Altman, said that they plan to appeal the court’s ruling.

In a last-ditch effort to help revive Detroit’s dismal economy, emergency manager Kevyn Orr has asked for an appraisal of the Detroit Institute of Arts’ (DIA) collection. While nothing has been finalized, Orr is considering whether the museum’s multi-billion dollar collection could be considered an asset to Detroit that could potentially be sold to help cover the city’s $15 billion debt.

Orr’s inquiry sparked an immediate reaction and DIA has hired bankruptcy lawyer Richard Levin of Cravath, Swaine & Moore to advise it in troubling situations and to protect the collection from any possible losses. Orr’s spokesman, Bill Nowling, assured the public that the appraisal is not a sign that they will be selling off the collection, an act that would surely be controversial, complicated, and mired by opposition. DIA is a unique public museum as Detroit retains ownership of its building and collection while a separate nonprofit institution manages its day-to-day operations.

While Nowling is adamant that Orr is not considering selling DIA’s collection, he did say that he would consider the museum’s holdings as assets of the city, especially as Detroit might be filing for bankruptcy. DIA’s collection includes major works by Pieter Bruegel the Elder (1525-1569), Henri Matisse (1869-1954), and Vincent van Gogh (1853-1890). Many of these masterpieces were donated by the city’s finest collectors, some of who have put restrictions on the works stipulating what DIA or the city can do with the works. If Orr does decide to sell works from DIA’s collection, it will undoubtedly prohibit the institution from receiving future donations and support.

Disgraced Knoedler Gallery Hit with New Lawsuit

Prominent Canadian art collector David Mirvish filed a lawsuit on Friday, February 22, 2013 against the disgraced New York-based art gallery, Knoedler & Company. Since closing its doors in late 2011, Knoedler & Company has been accused by multiple clients of selling forged paintings, which were acquired by the gallery from Long Island dealer Glafira Rosales. Mirvish’s is the fifth lawsuit against Knoedler since 2011.

However, Mirvish’s claim is slightly different than its predecessors. While the other lawsuits accused Knoedler of passing off fake Jackson Pollock (1912-1956), Robert Motherwell (1915-1991), and Mark Rothko (1903-1970) paintings as the real deal, Mirvish claims that the works he purchased from the gallery were authentic. Instead, Mirvish is arguing that he lost out on millions of dollars in profits when Knoedler failed to sell three Jackson Pollock masterpieces he purchased jointly with the gallery.

Between 2002 and 2007 Mirvish purchased two paintings attributed to Pollock and bough a half stake in a third for $1.6 million. The sole purpose of Mirvish’s dealings with Knoedler was to resell the works for a profit. One of the Pollock paintings sold to collector and hedge fund manager Pierre Lagrange for $17 million in 2007, but in 2011, the day before Knoedler shut down, Lagrange announced that he would be filing a lawsuit against the gallery as forensic testing suggested the painting was a fake. The Lagrange suit was eventually settled but Mirvish was not involved and refused to return the money he made off of the deal.

Mirvish is now seeking reparations for the two unsold Pollocks, claiming that Knoedler breached its agreement when the gallery suddenly went out of business. Mirvish is asking Knoedler to return the two paintings, referred to as “Greenish Pollock” and “Square Pollock,” as well as reimburse him for his $1.6 million stake in the third painting, referred to as “Silver Pollock.” Even though Mirvish only paid Knoedler $3.25 million, half of “Greenish Pollock” and “Square Pollock’s” purchase prices, he claims that Knoedler’s violation of contract entitles him to both paintings.

Nicholas Gravante, the lawyer of Knoedler’s former president, Ann Freeman, is representing Mirvish. Freeman is not named as a defendant in Mirvish’s case and she has maintained that all works acquired from Rosales are genuine. Rosales is currently under investigation by the F.B.I.
