Andy Warhol Foundation Ends Lengthy Legal Battle

The Andy Warhol Foundation for the Visual Arts has ended a six-year clash with its insurer Philadelphia Indemnity Insurance Company, recovering almost $6.6 million in legal fees. The battle between the foundation and its insurer began over authentication issues and snowballed to include the repayment of related legal fees.

The dispute began in 2007 when art collector Joe Simon-Whelan sued the foundation’s authentication branch for alleged fraud and conspiracy relating to the purchase of his 1965 Andy Warhol self-portrait, which he paid approximately $200,000 for in 1989 and was later deemed inauthentic. Another collector, Susan Shaer, filed a similar suit again the foundation in 2010 bringing the legal fees doled out to nearly $7 million.

According to a statement released by the foundation, “both suits alleged an absurd scheme to manipulate the prices for Andy Warhol’s (1928-1987) artwork yet [they] were forced to dismiss their claims in late 2010…The Foundation’s insurers nevertheless refused to reimburse the Foundation for its legal costs incurred in defending these bogus suits, alleging that the Foundation’s insurance policies did not cover claims of this nature.” The funds have since been repaid by Philadelphia Indemnity and transferred to the foundation’s endowment.

The Andy Warhol Foundation was established in 1987 following the artist’s sudden death. The organization’s mission is to support the creation, presentation and documentation of contemporary visual art.

The Dia Art Foundation, which closed its two galleries in Manhattan in 2004, has gathered about half the money needed to build its new space in New York City’s Chelsea neighborhood. While the organization has pushed their fundraising efforts into high gear, they are left without an acquisition fund for its collection, which includes works from the 1960s to the present.

The Dia Art Foundation announced that they will be holding a sale of paintings and sculptures at Sotheby’s in New York on November 13-14, 2013 to remedy that. The foundation hopes to raise at least $20 million by auctioning off works by Cy Twombly (1928-2011), John Chamberlain (1927-2011) and Barnett Newman (1905-1970).

The Dia Art Foundation’s collection includes works by modern and contemporary artists such as Andy Warhol (1921-1987), Joseph Beuys (1921-1986) and Louise Bourgeois (1911-2010). Philippe Vergne, the Dia’s director, has not commented on what works he’s hoping to acquired with the funds from the Sotheby’s sale.

Jean-Michel Basquiat’s (1960-1988) neo-expressionist painting Untitled (1982) sold for $29 million at Christie’s in London on June 25, 2013, surpassing its pre-sale estimate of $24.7 million. The work, which was acquired by the seller for $1.7 million in 2002, sold to a telephone bidder. Untitled was painted in the same year as Dustheads, the Basquiat painting that sold for $48.8 million in May 2013, setting the record for the artist at auction.

Other highlights from the Post-War and Contemporary art sale included Roy Lichtenstein’s (1923-1977) Cup of Coffee (1961), which sold for $4.2 million and exceeded its $3 million high estimate; Willem de Kooning’s (1904-1997) uncharacteristically serene Untitled XXVIII, which brought $4.4 million, well past its high estimate of $3.5 million; and Yves Klein’s (1928-1962) SE 181 (1961), a sculpture in the artist’s signature blue hue, which garnered $4.1 million, surpassing its high estimate of $2.7 million. However, not all lots fared so well. Andy Warhol’s (1928-1987) Colored Campbell’s Soup Can (1965) failed to meet its low estimate of $3.4 million due to its unpopular color palette. Steven S. Cohen, the disgraced founder and CEO of SAC Capital Advisors LP, previously owned the work.

Overall, the sale realized a total of $108.4 million and sold 90% by value and 80% by lot. Francis Outred, International Director and Head of Post-War & Contemporary Art, said, “Overall the auction showed an intelligent, solid market and a depth of global bidding, which is a testament to the worldwide interest in Post-War and Contemporary art.”

The Evening Sale of Impressionist & Modern Art that took place at Sotheby’s London on June 19, 2013 garnered $165.9 million, surpassing its high estimate of $164.3 million. The auction, which featured 71 works, sold 81.7% by lot and bidders hailed from 33 countries around the world.

The sale’s top lot was Claude Monet’s (1840-1926) painting of Venice, Le Palais Contarini (1908), which sold for $30.8 million after a three-way bidding battle. Other highlights included a Piet Mondrian (1872-1944) painting in the artist’s quintessential palette titled Red, Yellow and Blue (1927), which was scooped up by a telephone bidder for $14.5 million and Wassily Kandinsky’s (1866-1944) Bauhaus-era work on paper Ineinander (1928). A number of Surrealist works fared well at the sale including Max Ernst’s (1891-1976) La Horde (1927), which sold to New York’s Acquavella Galleries for $3.2 million and René Magritte’s (1898-1967) L’Idee, which features one of the artist’s well-known floating green apples and brought $7.1 million.

Helena Newman, Chairman of Sotheby’s Impressionist & Modern Art Department in Europe, said, “There was an extraordinary dynamic at play in the sale room. Established collectors – drawn out by the quality of the estate collections presented in the sale – competed with many of the new contender’s in today’s market. Record levels of participation were driven by a truly global audience.”

The evening auctions continue at Christie’s London on June 25, 2013 with its Post-War and Contemporary Art sale.

The Carnegie Museum of Art in Pittsburgh, PA has reopened its modern and contemporary art galleries following a major reinstallation. The updated galleries will be part of the Carnegie International, which is slated to open October 5, 2013. This year’s International will bring together 35 artists from 19 countries and will include a major exhibition of international art, the presentation of the museum’s collection, and a series of events organized in cooperation with the city of Pittsburgh.

Curators Dan Byers and Tina Kukielski helmed the reinstallation of the Scaife Galleries, which hold the Carnegie’s modern and contemporary art collections. Together they selected over 200 objects, many of which had been acquired through past Internationals, and redistributed them throughout 8 galleries.

Industrialist Andrew Carnegie founded the Carnegie Museum in 1895. Determined to build a bold collection of modern art, Carnegie organized annual contemporary exhibitions and sought to educate visitors, promote international understanding of art, and attract the world to Pittsburgh. Through acquisitions made from these yearly exhibitions, Carnegie built the museum’s impressive collection. The Carnegie International became an annual occurrence in 1896 and is the oldest exhibition of international contemporary art in North America and the second oldest in the world.

Art Basel Kicks Off in Switzerland

Art Basel, the most anticipated art fair in the world, will be held from June 13-16, 2013 in Switzerland. A VIP preview and vernissage were held on June 11 and June 12 respectively and included the $12 million sale of Alexander Calder’s (1898-1976) Sumac (1961) by London’s Helly Nahmad Gallery.

Now in its 44th year, Art Basel welcomes 304 international exhibitors to Messe Basel, a venue situated at the border of Switzerland, France and Germany. The fair presents the finest works of modern and contemporary art by more than 4,000 artists. Works on view include paintings, drawings, sculptures, installations, photographs, video and editioned works. The show is split into eight sectors – Galleries, Feature, Statements, Edition, Unlimited, Parcours, Film, and Magazines – and allows patrons to explore the many facets of modern and contemporary art including museum-quality paintings, curated projects, and site-specific artworks.  

The remarkable roster of exhibitors includes Acquavella Galleries Inc. (New York), Castelli Gallery (New York), Gagosian Gallery (multiple locations), Hauser & Wirth (Zurich/New York), Dominique Levy (New York), and Lisson Gallery (Milan/London).

Art Basel offers a full program of events including symposiums, artist talks, and lectures. Featured participants include Massimiliano Gioni, curator of the 55th Venice Biennale and Director at the New Museum, and Hans Ulrich Obrist, co-director of the Serpentine Gallery in London.

Outsider Art Fair Takes on Paris

The Outsider Art Fair, a 21-year-old, New York-based event dedicated to self-taught artists and avant-garde artworks, will take on Paris this fall. The inaugural edition of the fair in Paris will be held from October 24-27, 2013 at Hotel Le A, a boutique hotel near the Grand Palais. Founded by Sanford Smith, the fair was acquired by Wide Open Arts in 2012 and will coincide with FIAC, France’s leading contemporary art fair.

Outsider Art, known as Art Brut in France, has played a significant role in French art. The French painter Jean Dubuffet (1901-1985) coined the term Art Brut in response to America’s recognition of outsider art. Groundbreaking outsider art exhibitions have also been held at renowned French institutions including the Musee des Arts Decoratifs, Halle Saint Pierre, Foundation Cartier, and Palais de Tokyo.

Paris’ Outsider Art Fair will welcome galleries from across the globe and works by iconic outsider artists such as Henry Darger (1892-1973), Martín Ramírez (1895-1963), Bill Traylor (1854-1949), and Joseph Yoakum (1889-1972) will be presented.

On June 5, 2013 at Sotheby’s New York the Corcoran Gallery of Art auctioned 25 rugs from its William A. Clark Collection. The rugs, which are from the 16th and 17th centuries, brought in $43.7 million, over four times the pre-sale high estimate of $9.6 million, making it the most successful carpet auction ever held. 100% of the lots sold and the auction achieved “White Glove” status, meaning every lot in the sale garnered more than it’s pre-sale high estimate.

The highlight of the auction was the Clark Sickle-Leaf Carpet. An important and iconic rug created by an unknown Persian artist during the first half of the 17th century, the rarely exhibited piece was expected to garner between $5 million and $7 million. The carpet ended up selling for $33.7 million, the highest price paid for any carpet at auction. Mary Jo Otsea, the senior consultant for rugs and carpets at Sotheby’s said, “Selling the Clark Sickle-Leaf Carpet for a record-breaking price of more than three times the previous auction record for a carpet has unquestionably been the highlight of my 30 year career. It is gratifying to see the strength of the market for carpets of this quality and rarity.”

The rugs were part of a bequest from William Clark (1839-1925), a Montana-based entrepreneur-turned-senator, to the Corcoran in 1925. The gift was comprised of 200 paintings and drawings and a number of other works, including the rugs. The Corcoran will use the proceeds from the sale to support future acquisitions that will better fit the institution’s focus on American and contemporary art. While the Corcoran has endured recent financial troubles, the money will not be used for operating expenses in keeping with its deaccession policy.

After a whirlwind of auctions last week in New York, which included a historic $495 million post-war sale at Christie’s, Phillips’ Contemporary Art Evening Sale on May 16, 2013 seemed quite subdued. The boutique auction house’s sale garnered $78.6 million and sold 81% by lot and 88% by value.

The highlight of the night was Andy Warhol’s (1928-1987) Pop Art masterpiece, Four Marilyns (1962), which sold for $38.2 million. The sale confirmed that Warhol remains a powerful presence in the art market. During the auction two other Warhol works were sold -- Flowers (1964), which brought $2.4 million and Marilyn Monroe (Marilyn) (1967), which sold for upward of $2 million. Other major sales that night included Jean-Michel Basquiat’s (1960-1988) Untitled (1961), which garnered over $4 million and Roy Lichtenstein’s (1923-1997) Still Life (1972), which also sold for upward of $4 million.

Phillips has undergone a number of changes in the past year. Following the departure of Chairman Simon de Pury in December 2012, the company changed its name from Phillips de Pury & Co. to Phillips. In February 2013, the auction house revealed 10,000-square-feet of new gallery space at the company’s headquarters on Park Avenue in Manhattan. The expansion was an attempt to compete with the major auction houses such as Sotheby’s and Christie’s.

Christie’s Post-War and Contemporary Evening Art Auction on May 15, 2013 in New York garnered $495 million – the highest total in auction history. Packed with masterpieces from an array of important art movements including Abstract Expressionism and Pop, many of the works offered were from lauded private collections and institutions. Brett Gorvy, Chairman and International Head of Post-War and Contemporary Art, said, “The remarkable bidding and record prices set reflect a new era in the art market, wherin seasoned collectors and new bidders compete at the highest level within a global market.”

The top lot of the night was Jackson Pollock’s (1912-1956) Number 19, 1948 (estimate: $25 million - $35 million). A prime example of Pollock’s drip paintings, the work sold for $58.3 million and set the record for the artist at auction. The influential art critic, Clement Greenberg, singled our Number 19 as the painting that offered enough proof to justify calling Pollock one of the most significant painters of our time.

Other highlights include Roy Lichtenstein’s (1923-1997) iconic work of pop art, Woman with Flowered Hat (1963) (estimate: approximately $30 million), which sold for $56.1 million and set the record for the artist at auction; Jean Michel-Basquiat’s (1960-1988) Dustheads (estimate: $25 million - $35 million), a neo-expressionist work from the 1980s, which sold for $48.8 million, an auction record for the artist; and Mark Rothko’s (1903-1970) color field painting, Untitled (Black on Maroon) (1958) (estimate: $15 million-$20 million), which sold for $27 million.

Out of 70 works offered at last night’s auction, only 4 failed to find buyers.
